PARAMEDICAL INSTITUTIONS AND RECOGNITION
Recognition of Paramedical Qualification in certain emes. 24.

Where any Paramedical Institution is established or any Paramedical institution opens a new or higher course of study except with the previous permission of the State Government in accordance with the provisions of this Act, no Paramedical qualification granted to any student of such Paramedical institution shall be a recognised Paramedical qualification for the purposes of this Act.
 

Time for seeking Permission for certain existing Paramedical Institution. 25.

If any person has established a Paramedical institution or any Paramedical institution has opened a new or higher course of study or training or increases, the admission capacity, such person or Paramedical l institution, as the case may be, shall seek within a period of one year from the commencement of this Act, the permission of State Government in accordance with the provisions of this Act,.
 

Recognition of Qualification granted by University or Paramedical Institution in India.
 
26.

The Paramedical qualifications granted by Indian Medical Institutions, which are included Paramedical in the Schedules to the Council Act, 1956 (No. 102 of 1956) shall be recognised Paramedical qualifications for the purpose of this Act.

Recognition of Paramedical qualification granted by Paramedical Institution in countries with which there is a scheme of reciprocity. 27.
(1)

'Re Paramedical qualification. granted by medical institutions outside, India, which are included in the Schedule to the Medical Council Act, 1956 (No. 102 of 1956) shall be recognised Paramedical qualifications for the purpose of this Act.

(2)

The State Government after consultation with the Council may by notification in the Official Gazette amend the Schedule by directing that an entry be made therein in respect of any Paramedical qualification declaring that it shall he recognised Paramedical qualification only when granted before a specified date.

(3)

Where the Council has refused to recommend any Paramedical qualification which has been proposed for recognition by any Authority referred to in sub-section (2) and that Authority applies to the State Government in this behalf, the State Government after considering such application and after obtaining from the Council a report, if any, as to the reasons for any such refusal may by notification in the Official Gazette amend the Schedule so as to include such qualification therein and the provision of sub-section (2) shall apply to such notification.

Recognition of Paramedical Qualification granted by certain Paramedical institutions Whose qualification are not included in the Schedule.
 
28.

Any Paramedical institution in India, which desires a Paramedical qualification granted by it, to be included in the Schedule, may apply to the State Government with such application fee as may be fixed by regulation to have such qualification recognised and the State Government, after consulting the council, may by notification in the Official Gazette, amend the Schedule as to include such qualification therein, and any such notification may also direct that an entry shall be made in the last column of Schedule against such Paramedical qualification declaring that it shall be a recognised Paramedical qualification only when granted after a specified date.

Power to require information as to courses of study and qualification, examinations.
 
29.

Every University or Allied Heath Institution in India which grants a recognised Paramedical qualification, shall furnish such information as the Council, may, from time to time, require as to the courses of study and exanimations to be undergone in order to obtain such as to the ages at which such courses of study and examinations are required to be undergone and such qualifications conferred and generally as to the requisites for obtaining such qualification.

Inspection of Paramedical Institution.
 
30.

The Council shall cause all Paramedical Institution to be inspected as and when deemed necessary.

Withdrawal of recognition. 31.
(1) If it ap~ to the Council
(a)

that the courses the study and examination to be undergone in or the proficiency required from candidates at any examination held by any University or Paramedical institution; or

(b)

that the staff, equipment, accommodation, training and other facilities for instruction and training provided in such University or Paramedical institution or in any college or other institution affiliated to that University do not conform to the standards prescribed by the Council;

the Council shall take action for the withdrawal of recognition.
(2)

Before withdrawal of recognition the Council shall send a show cause notice to the Paramedical Institution or University specifying the period within which the reply shall be submitted.12 (28)

(3)

On recipt Of the reply Or where no reply is submitted within the period specified in the show cause notice then on the expiry of that period the Council shall take decision in the matter.

'Re Council may prescribe the minimum standards of Paramedical education required standards of for granting recognised Paramedical & Education Council qualifications (other than postgraduate Paramedical qualification) by Universities or Paramedical Institutions in India.

 


AMENDMENTS

In the said rules,-

  1. In rule 4,-

(1) for sub-rule (e), the following sub-rule shall be substituted, namely:-

“(e)

(i)

That the applicant owns and manages a hospital of not less than 100 beds (for post-graduate, graduate degree, diploma and certificate courses) on the basis of average 1:3 ratio (three students on one bed) with necessary infrastructural facilities and capable for being developed into teaching institution as prescribed by parishad and which is in the vicinity of the proposed institute: If the institute provides students the facility for transportation, the application related to the recognition of the institution may be considered even if distance of the hospital from institute is up to 15 km.

 

(ii)

That on availability of a hospital having minimum of 100 beds, the application for permission of the applicant may be considered and permitted after being satisfied.

 

(iii)

That the institution which wishes to conduct Para-medical courses at district level and block level including district of divisional head quarters, and has obtained affiliation with a Government Hospital having minimum 100 beds (1: 3 three students on one bed), then the application for permission shall be considered as per the following: -

   

(a)

In case of the permission /Affiliation with government hospital, Priority will be given to the courses of educational institutions existing ;

   

(b)

In the case of equal seniority, the infrastructure & facilities of the proposed educational institution, the results of previous years' examinations, shall be the decesive factor .

(2) for sub-rule (j) the following sub-rule shall be substituted, namely:-

"(j) That the Applicant shall submit a fixed deposit of rupees three lakh for one to three courses, rupees five lakh for one to ten courses and for more than ten courses in addition to rupees five lakh at the rate of two lakh for each additional course for all subjects in favour of the parishad for fulfilment of infrastructural, teaching and other standard norms. If the parishad is of the opinion that the institution is not working as per rules then fixed deposit submitted by the institution shall be forfeited by the parishad. "

  1. In rule 5, for opening Para, the following para shall be substituted, namely:-

“Subject to the fulfilment of the eligibility criteria and qualifying criteria, the application for permission to establish a new Para-Medical Educational Institute shall be submitted online by the applicant in the following three part:-”

  1. For rule 6, the following rule shall be substituted, namely:-

“6. Application fees.-

(1) In case of submitting application on or prior to the last date prescribed for application of recognition, Application fees per course will be deposited in favour of Madhya Pradesh Paramedical Council Bhopal, on line by Internet Banking, RTGS, IMPS or NEFT as per the following.-

(i)

60500/- (Sixty thousand five hundred rupees only)

 

for post-graduate degree course

(ii)

33000/- (thirty three thousand rupees only)

 

for graduate degree course

(iii)

22000/ (Twenty-two thousand rupees only)

 

for the diploma course

(iv)

16500/-(Sixteen thousand five hundred rupees only)

 

for the certificate course

 

(2) An escalation of 6 percent will be made every year in the above amounts.

(3) In case of late submission of application for recognition, same shall be considered after approval of Chairman MP Paramedical Council if along with the application fees prescribed in sub-rule (1), an additional fee is remitted as per the following.-

(i)

Application by the prescribed last date

 

No additional fees shall apply

(ii)

Up to 15 Days from the prescribed last date

 

An amount equal to 5 percent of prescribed fees.

(iii)

Up to 30 Days from the prescribed last date

 

An amount equal to 10 percent of prescribed fees.

(4) No application shall be entertained after a period of 30 Days from the last date prescribed for recognition.

(5) The fee is inclusive of registration, technical security, contingency expenditure and inspection / evaluation of examination at the end of each professional examination. If the inspection of the institution is not made before commencement of academic session by the Inspection Committee directed by the Council / State Government, then on the request of the institution after deduction of 10 percent remaining amount shall be refunded to the institute;

Provided that for any technical reason inspection is not made or the applicant wishes not to carry out such inspection then on the request of the institution in writing, after deducting the amount as prescribed below from the fees deposited by the institution, the remaining amount of fees shall be considered to be refunded: -

(i)

On being requested within 30 days of Application

 

10 percent amount shall be deducted

(ii)

On being requested within 180 days of Application

 

25 percent amount shall be deducted.

No application for refund shall be considered after 180 days.

  1. For rule 9, the following rule shall be substituted, namely:-

"9. Evaluation.-

(1) The parishad shall evaluate Part-A of the application in the first instance the desirability and prima facie feasibility of setting up the Paramedical educational institution at the proposed location and shall also evaluate the capability of the applicant to provide the necessary sources and infrastructure for the scheme. The parishad while evaluating each part of the application may seek further information, clarification or additional documents from the applicant as considered necessary. Thereafter physical verification shall be carried out by the committee constituted per sub-rule (2). On the report submitted by the said committee, grant of recognition shall be considered.

(2) The committee for verification shall comprise of the following, namely:-

Collector or his representative who is not below the rank of Additional Collector / Joint Collector

 

Chairman-Nodal Officer

2.

Executive Engineer, Public Works Dept. or his representative

 

Member

3.

Subject Specialist of Medical College (for those places only where Medical College exists) / Chief Medical and Health Officer or his representative

 

Member

4.

District AYUSH Officer (Only for those institutions that have applied for AYUSH related courses)
